The Office of the New York State Attorney General's Medicaid Fraud Control Unit (MFCU) is seeking an attorney with substantial investigatory experience to lead the Westchester-Rockland Regional Office, which serves seven counties in the lower Hudson Valley Region of New York. This position is based in Pearl River. The scope of MFCU's mission includes the following:
o Working in coordination with other state, federal or local government prosecutorial agencies and utilizing the New York State Penal Law, the False Claims Act, Social Services Law 145-b, and the Executive Law to investigate, prosecute and obtain criminal and civil remedies against individuals and corporate entities responsible for improper or fraudulent Medicaid billing schemes. Many of the Unit's matters have resulted in revenue-generation through the large-scale recovery of taxpayer money. o Investigating and prosecuting allegations of abuse and neglect of residents in nursing homes and other residential healthcare facilities. The importance of this work is highlighted in the OAG's report investigating allegations of COVID-19 related neglect of nursing home residents across New York State. o Making program integrity recommendations to ensure New York's $96.5 billion Medicaid budget can continue serving over seven million New Yorkers. Responsibilities of the Regional Director will include but not be limited to the following:
o Managing a team of approximately 30 employees in service of the Unit's mission, including reviewing their work and supporting their professional development; o Consulting and working collaboratively with the MFCU Executive team in New York City, the six other Regional Directors, and the supervising auditors and detectives to enhance the Unit's ability to utilize resources efficiently and effectively in support of its mission, particularly when these initiatives have a multi-region impact; o Overseeing investigative planning, as well as leading and supervising team-based investigations of allegations of financial fraud in the healthcare industry and of abuse and neglect of residents of healthcare facilities; o Presenting evidence to grand juries and conducting evidentiary hearings and trials in New York State courts; o Reviewing charging instruments, memoranda recommending charges, plea agreements, search warrants, indictments, civil complaints, civil settlement agreements and other MFCU materials; o Carrying an individual docket of matters as warranted by the Region's caseload; and o Serving as the Unit's primary point of contact for interagency and community relationships in the lower Hudson Valley.

Salary Range:
From $150101 to $171344 Annually
Minimum Qualification
Applicants must possess the following minimum
Qualifications:
o A minimum of ten (10) years of practice experience, including substantial grand jury and trial experience that preferably includes the investigation and prosecution of financial crimes, as well as experience in local town and village justice courts. Experience with parallel proceedings or civil litigation is a plus; o At least 4 years of experience supervising and leading attorneys and support staff with the demonstrated ability to foster a collegial and productive work environment; o Experience working with multiple agencies and partners in the community; o Excellent analytical, communication, writing, legal research and organizational skills; o Experience drafting and overseeing the execution of search and eavesdropping warrants is a plus; o Sound judgment with the ability to work equally well independently or as a productive team member; o Technology proficiency that includes a knowledge of and experience using Microsoft Office applications and case management and eDiscovery platforms; and o Frequent travel downstate is required for the Unit's investigations, court appearances and outreach.Estimated Salary: $20 to $28 per hour based on qualifications.

Don't Be Fooled

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
